OVERVIEW

These Terms of Service apply when you use The Clever Bag Company website or purchase products from us.

Throughout these Terms, “we”, “us” and “our” refer to The Clever Bag Company. Our online store is hosted by Shopify.

By placing an order with us, you agree to these Terms of Service. Nothing in these Terms affects your statutory rights as a consumer.

1. OUR PRODUCTS

We take reasonable care to ensure that product descriptions, photographs, prices and other information on our website are accurate.

Colours and appearance may vary slightly depending on your screen or device. Product packaging may also vary.

All products are subject to availability. If an item becomes unavailable after you place an order, we will contact you and provide an appropriate refund.

2. ORDERS

When you place an order, you are making an offer to purchase the products in your order.

We will send you confirmation that your order has been received. We reserve the right to decline or cancel an order where reasonably necessary, for example because an item is unavailable, there is an obvious pricing error, payment has not been authorised or we reasonably suspect fraudulent activity.

If we cancel an order after payment has been taken, we will refund the relevant amount.

Please check the information you provide when ordering, including your email and delivery address, carefully.

3. PRICES AND PAYMENT

Prices are displayed in pounds sterling (£).

The price charged will be the price displayed when you place your order, subject to the correction of obvious errors.

UK delivery is free on all orders. No delivery charge is added at checkout, including where items in your order are fulfilled by different suppliers.

Payment is processed securely through the payment methods offered at checkout.

4. DELIVERY

We work with a number of carefully selected supplier and fulfilment partners. This means products may be dispatched directly from different locations and an order containing several products may arrive in more than one parcel.

Estimated delivery times are shown on individual product pages. These are estimates rather than guaranteed delivery dates. Where items are fulfilled by different suppliers, they are dispatched separately and may arrive on different days. UK delivery remains free regardless of how many parcels your order arrives in.

We remain responsible for your order until it is delivered to you, or to another person you have identified to receive it, unless you have independently arranged your own carrier.

5. CANCELLATIONS AND RETURNS

Your rights to cancel an online order, return products and receive refunds are explained in our Delivery & Returns Page.

Nothing in these Terms or our Delivery & Returns Page affects your statutory rights.

6. FAULTY, DAMAGED OR INCORRECT PRODUCTS

Products must be as described, fit for purpose and of satisfactory quality as required by applicable UK consumer law.

If an item is faulty, damaged or not what you ordered, please contact us at hello@thecleverbagcompany.co.uk.

Your statutory rights in relation to faulty or misdescribed goods are not affected by these Terms.

7. PROMOTIONS AND DISCOUNT CODES

From time to time we may offer promotions or discount codes.

Additional conditions may apply to a particular promotion and will be explained with the offer. Unless otherwise stated, discount codes cannot be exchanged for cash.

We reserve the right to withdraw or amend a promotion where reasonably necessary, but this will not affect orders already accepted.

8. WEBSITE USE

You must not misuse our website, knowingly introduce malicious software, attempt unauthorised access or use the website for unlawful purposes.

We may suspend or restrict access where reasonably necessary to protect our website, customers or business.

9. INTELLECTUAL PROPERTY

The content of this website, including The Clever Bag Company branding, text, graphics and original website content, is protected by applicable intellectual property laws.

Third-party trademarks, product names, photographs and other material remain the property of their respective owners where applicable.

You may use our website for your personal, non-commercial use. You must not reproduce or commercially exploit our original content without permission.

10. OUR RESPONSIBILITY TO YOU

We do not exclude or limit liability where it would be unlawful to do so.

Nothing in these Terms limits your statutory rights or our responsibility for products that are faulty, not as described or otherwise fail to meet requirements imposed by law.

We are not responsible for losses that were not reasonably foreseeable when the contract was made or for business losses arising from purchases made wholly or mainly for business purposes, to the extent permitted by law.
